COURT AUTHORITY
Arkansas Code Annotated §16-7-202(b) authorizes the circuit and appellate courts to order any civil, probate, domestic relations, or juvenile case to mediation.
CHOOSING YOUR MEDIATOR
Usually, with the assistance of counsel, parties can select a mediator certified by the Arkansas Alternative Dispute Resolution Commission.
It is possible to use an attorney not on the list of certified mediators, a Private Mediator. To choose a Private Mediator, the parties must obtain permission from the court.
Private Mediators are not subject to the Commission’s ethical rules or disciplinary process.
WHAT DOES THE MEDIATOR SHARE WITH THE COURT
Mediation is confidential.
Your mediator is prohibited from providing an assessment, evaluation, recommendation, finding, or other communication regarding the mediation to the court.
A mediator will provide the court with a "Mediator's Report".
A Mediator's Report provides the basic details;
- whether or not the mediation occurred or has terminated;
- whether a settlement was reached; and
- who attended the mediation.
Your mediator cannot share mediation communications with the court.*
