At Blue Elephant Circus, our mediation process is a voluntary and collaborative approach to resolve disputes that offers parties an alternative to traditional legal approaches.
Through mediation, each party gains a better understanding of the other's perspective, and the mediator may meet separately with each party to address emotional or factual issues. This can help parties develop creative and tailored solutions that meet their specific needs, even ones that may not be available through a court of law.
Agreements reached through mediation are generally put in writing and can become enforceable contracts or court orders. If no agreement is reached, parties retain their legal rights and can pursue other options such as arbitration or going to trial.
Mediation can be used in most conflicts, ranging from disputes between consumers and merchants to complex business disputes or personal injury matters. It can also be used at any stage of the conflict, including facilitating settlements of a pending lawsuit.
General Process:
Introduction and Ground Rules: The mediator will start by introducing themselves and explaining the mediation process and ground rules.
The parties will then have an opportunity to explain their views of the dispute and discuss their desired outcomes.
Joint Sessions: The mediator will facilitate joint sessions, where both parties will discuss the issues and work towards a mutually acceptable agreement.
During this process, the mediator will help parties to communicate effectively and explore creative solutions.
Separate Sessions: At times, the mediator may meet separately with each party to address emotional or factual issues that could be impeding the negotiation process.
Agreement: If the parties reach an agreement, the mediator will assist in drafting a written agreement that reflects the terms of the settlement. This agreement can become an enforceable contract or court order.
Follow-up: The mediator may follow up with the parties after the mediation session to ensure that the agreement is being carried out as planned.
